Right of Withdrawal and Returns

Under current legislation, the consumer has 14 days to exercise the right of withdrawal, except in the exceptions provided by law.

 

For the return to be accepted, the product must be:

 

• In perfect condition;

 

• Without signs of use, improper assembly or damage;

 

• In the original packaging;

 

• Complete, with all accessories and documentation.

 

Return shipping costs are the responsibility of the customer, except in cases of error attributable to Mançana or legally proven defect/non-conformity.

 

The following are excluded from the right of free resolution, under the terms of Article 17 of Decree-Law No. 24/2014:

 

• Personalized products;

 

• Products made to order;

 

• Products manufactured according to customer specifications;

 

• Products ordered from suppliers specifically for the customer;

 

• Display items, clearance items or promotional items with express indication;

 

• Products that, by their nature, cannot be returned after opening, use, assembly or handling.

 

When a product is ordered from a supplier specifically to fulfill a customer's order, Mançana acts within the scope of a commercial operation exclusively for that order, not necessarily maintaining the item in regular stock.

 

In these cases, after order confirmation, payment and commencement of production or order to the supplier, cancellation, return or refund is not possible, except in legally foreseen cases of defect or non-conformity.

 

Professional Purchases — B2B

When a purchase is made within the scope of a professional activity, namely by a company, architect, designer, decorator, project office, hotel, retail, restaurant or other professional client, it is considered a B2B relationship.

 

Indications of a professional purchase include, among others:

 

• Order placed by a company or professional;

 

• Invoice issued with a company tax ID (CNPJ);

 

• Use of the product in commercial activity or professional project;

 

• Purchase intended for resale, construction, hotel, office, store or commercial space;

 

• Involvement of an architect, designer, decorator or other professional.

 

In B2B relationships, the legal regime for consumer protection does not apply, nor does the 14-day right of withdrawal provided for in Decree-Law No. 24/2014.

 

B2B sales are governed by the Portuguese Civil Code, namely the articles relating to the contract of sale, the principle of freedom of contract and the principle of the binding force of contracts.

 

Therefore, for professional purchases:

• There is no automatic right of return within 14 days;

 

• There is no unilateral cancellation of the order;

 

• There is no obligation to refund after order confirmation;

 

• The contract must be punctually fulfilled by the parties.

 

Mançana may refuse cancellations that imply financial loss, costs with suppliers, start of production, acquisition of materials or order to the supplier.

 

Mançana may, as a mere commercial courtesy, analyze alternative solutions, provided that they do not imply harm to the company, and such analysis does not constitute any acknowledgment of legal obligation.
